The FBI never asked the Democratic National Committee if it could examine a computer server that was the subject of cyber attacks last year.
Instead federal law enforcement relied on data that, Crowdstrike, a private computer security company, gathered from the device.
The FBI later endorsed the conclusion that Russian intelligence services were behind the hacking, and that their goal was to help Donald Trump win the November presidential election.

“[Russian President Vladimir] Putin publicly pointed to the Panama Papers disclosure and the Olympic doping scandal as US-directed efforts to defame Russia, suggesting he sought to use disclosures to discredit the image of the United States and cast it as hypocritical,” the report stated on Friday. The accusation is one of many contained in a 13-page report that was ordered by US President Barack Obama in response to outrage in his Democratic Party over Clinton’s unexpected defeat by President-elect Donald Trump.

So – whatever you think about Wikileaks – anyone claiming that the Wikileaks documents are forged or altered is wrong.

WikiLeaks published on Friday over 2,000 of what it describes as emails hacked from an account belonging to John Podesta, chairman of Hillary Clinton’s presidential campaign, in the first of a string of file dumps promised by WikiLeaks’ founder in the weeks leading up the Nov. 4 elections.
In a Twitter post following the publications, Mr. Podesta appeared to confirm that at least some of the emails were authentic.
“I’m not happy about being hacked by the Russians in their quest to throw the election to Donald Trump,” he wrote. “Don’t have time to figure out which docs are real and which are faked.
One leaked email dated January 25 contains excerpts of transcripts from paid speeches given by the Democratic presidential candidate. The existence of those transcripts was seized upon during Democratic primaries by Bernie Sanders’ campaign, which repeatedly called for their release.

Former CIA acting director Michael Morell said President-elect Donald Trump’s rhetoric will undermine the agency by causing a “wave of resignations” and affecting its ability to work with foreign intelligence services.
“First, expect a wave of resignations. Attrition at the C.I.A., which has been remarkably low since Sept. 11, 2001, will skyrocket,” Morell wrote in a New York Times op-ed published Friday.

Some hackers have lost their way. Today, countless techies have entered the for-profit cybersecurity business, potentially neglecting what one security researcher calls their responsibility to civil society: helping at-risk users like dissidents with the security of their work, for example.
To that end, Claudio Guarnieri, who has spent years analyzing cyberattacks against activists and journalists, has launched a new project tentatively titled ‘Security Without Borders’, which he hopes will more effectively connect white hat hackers with targeted groups and individuals. Guarnieri announced the project at the Chaos Communication Congress hacking festival in Hamburg on December 28.
“Civil society basically isn’t going to secure itself,” Guarnieri told Motherboard in an interview. “It’s not going to be able to build that kind of expertise that is required to actually face the issues and even understand the issues that exist.”

- 13 Year-Old Boy Permanently Disabled from Chicken Pox Vaccine Wins His Case in Vaccine Court
A young man was recently awarded compensation in the United States Court of Federal Claims Vaccine Court, for injuries he sustained after being administered the hepatitis A and varicella vaccinations in 2009. After five long years of litigation, Health and Human Services (HHS), the Respondent in all vaccine injury cases, conceded that the varicella vaccination did in fact cause RD’s vaccine injury, transverse myelitis, which has left him a tetraplegic.
In November 2014, HHS conceded that the vaccination caused RD’s injuries. Even with this concession, his case continued for another year in the damages phase, during which time the parties continued to negotiate the amount of damages that RD would receive for his injuries. Although he was compensated for his suffering and injuries, the monetary award will never compensate for the lifelong effects this young man is suffering from his vaccine injury.
Five Long Years
RD was only 13 when his life changed forever. At a routine well-child visit in 2009, the doctor informed RD’s parents that he was due to receive the hepatitis A and varicella vaccinations. His parents complied with the doctor’s order and RD received the vaccinations.
RD’s mother explained that, at that time in RD’s state, only one dose of varicella vaccine was required and RD had already received one dose of that vaccine. This second dose that was administered to RD at this well visit was determined to be the cause of RD’s horrific injuries, and it was not even required for him, which his family didn’t realize until it was too late.

- SEC Illegally Appoints Admin Law Judges
The Securities and Exchange Commission illegally appoints administrative law judges in violation of the Constitution’s Appointments Clause to render decisions and impose penalties, the 10th Circuit ruled Tuesday.
The ruling vacated an agency fraud determination against a Denver businessman on the basis that the SEC administrative law judge who heard the case was not “constitutionally appointed” and held his office in violation of the Appointments Clause, U.S. Circuit Judge Scott Matheson, Jr. wrote for a divided three-judge panel in a 37-page opinion.
In 2012, the SEC accused petitioner David F. Bandimere of committing two securities fraud violations and two securities registration violations, and an SEC administrative law judge presided over a “trial-like hearing,” Matheson wrote.
The SEC administrative law judge concluded Bandimere broke the law; the judge then imposed civil penalties and ordered disgorgement of profits. A subsequent review by the SEC reached the same conclusion.
But Bandimere petitioned for review, claiming the SEC administrative law judge was not constitutionally appointed.
“The [SEC’s] opinion must be vacated because it resulted from a process in which an improperly appointed inferior officer played an integral role,” Bandimere argued in his petition.
The 10th Circuit granted review to Bandimere’s case, setting aside the SEC’s opinion and vacating its findings against Bandimere.
The SEC concedes the administrative law judge was not constitutionally appointed, but disagrees that this makes him “an inferior officer,” Matheson wrote.

- Two Major Credit Reporting Agencies Have Been Lying to Consumers
In personal finance, practically everything can turn on one’s credit score. It’s both an indicator of one’s financial past, and the key to accessing necessities—without insane costs—in the future. But on Tuesday, the Consumer Financial Protection Bureau announced that two of the three major credit-reporting agencies responsible for doling out those scores—Equifax and Transunion—have been deceiving and taking advantage of Americans. The Bureau ordered the agencies to pay more than $23 million in fines and restitution.
In their investigation, the Bureau found that the two agencies had been misrepresenting the scores provided to consumers, telling them that the score reports they received were the same reports that lenders and businesses received, when, in fact, they were not. The investigation also found problems with the way the agencies advertised their products, using promotions that suggested that their credit reports were either free or cost only $1. According to the CFPB the agencies did not properly disclose that after a trial of seven to 30 days, individuals would be enrolled in a full-price subscription, which could total $16 or more per month. The Bureau also found Equifax to be in violation of the Fair Credit Reporting Act, which states that the agencies must provide one free report every 12 months made available at a central site. Before viewing their free report, consumers were forced to view advertisements for Equifax, which is prohibited by law.
That these credit agencies would abuse their power to mislead Americans attempting to take a more active role in monitoring their financial health is not only a violation of trust, it is dangerous.
