Ammon Bundys inalienable Right To Travel
Driving vs Traveling
The founding of our Constitution gave the requirement for governments of the United States to create law in respect on the Constitutions plain texts. Meaning lawmakers were not supposed to create law that infringes on the Amendments plain texts and the rights it assumes.
The inalienable Right To Travel freely without permission from government has been a long time recognized right. The question is wether it's lawful to assume Statutory law prohibition of free exercises exist.
The free exercise to travel freely not suffering from unlawful detention without due process of law is basic law in the United States.
It's how you travel freely is what can be regulated by governments. To Travel without a license in a vehicle not for commercial use and not operating in the 4 hire capacity is a protected Constitutional activity.
No law punishes conduct that is constitutional in Bundys case, it's the fact of how the law is applied to his conduct that is constitutional in which makes misapplication of law truly stand out.
Ammons theory, is common and constitutional. There is no law in which he was charged under in the State of Utah that prohibits his conduct of traveling freely if his vehicle is not for commercial use and not operated in a 4 hire capacity. This is only true because all citizens are nationals.
Ammons conduct being the cause for his arrest for exercising his constitutional rights to travel freely is not good enough.
